The European Commission has determined that leading adult websites – including Pornhub, Stripchat, XNXX, and XVideos – are failing to adequately protect minors from exposure to pornographic content. The findings, released Thursday, suggest these platforms may be in breach of European law under the new Digital Services Act (DSA).
Weak Age Verification Systems
The core issue lies in the platforms’ reliance on simplistic age-verification methods. Currently, users confirm their age with “a single click,” a system the Commission deems completely ineffective at preventing underage access. Other measures like blurring content or labeling restrictions were also found insufficient.
This matters because the DSA is designed to hold large online platforms accountable for user safety. The EU is cracking down on digital services to protect vulnerable groups, and these findings indicate major platforms have not taken this responsibility seriously.
Business Concerns Over Child Safety
The Commission’s year-long investigation, launched in May, analyzed internal risk reports from all four sites. The results reveal that when potential risks to young users were identified, the platforms prioritized business concerns – such as damage to reputation – over the actual safety of children. This suggests a systemic failure to prioritize user welfare.
Next Steps and Potential Penalties
The platforms now have an opportunity to respond in writing, outlining how they will implement more robust age-verification systems. However, failure to comply could result in severe penalties: fines up to 6% of the platform’s annual worldwide turnover.
Additionally, national authorities are coordinating action against smaller, non-compliant pornographic platforms. The EU is signaling it will not tolerate weak enforcement of the DSA, especially when it comes to protecting minors online.
These findings reinforce the EU’s commitment to enforcing digital safety standards, and they put significant pressure on major adult platforms to take concrete action. Failure to do so will have serious financial consequences, while also raising ethical concerns about their business practices.
